1. Agreement
These Terms of Use ("Terms") are a binding agreement between you and FX Aura Trading ("we", "us"). They apply to fxauratrading.com, the dashboard, the bot (Expert Advisor) files and everything else we provide (together, the "Service"). By creating an account, logging in or otherwise using the Service you agree to these Terms, the Privacy Policy, the Risk Disclosure and the Cookie Notice. If you do not agree, do not use the Service.
2. Who may use the Service
You must be at least 18 years old and able to enter a binding contract. You may use the Service only where doing so is lawful. You may only connect trading accounts that you own or are expressly authorized to view. You must not use the Service if you are barred from doing so under applicable sanctions or other laws. Forex and leveraged products are restricted or prohibited in some places; you alone are responsible for knowing and following the rules that apply to you.
3. What the Service is (and is not)
FX Aura Trading is a read-only monitoring and information platform. It receives data that your own bot sends from your MetaTrader 4 or MetaTrader 5 account and shows it to you in a dashboard, together with market prices, charts, a news feed and an economic calendar. It also lets you create reports and share a view-only login.
We are not a broker, dealer, exchange, bank, investment adviser, commodity trading adviser, signal provider or money manager. We do not open or manage trading accounts, hold or move money, place, change or close trades, or recommend any trade, strategy, broker or product. We do not ask for, and you must never give us, the master (trading) password of an account. Nothing in the Service is an offer or solicitation to buy or sell anything.
4. No advice
All information is general and for your own information only. It is not financial, investment, trading, tax, accounting or legal advice and does not take your situation into account. Automatic scores, labels and estimates (for example the "impact on gold" rating of a headline) are rough, rule-based estimates and can be wrong. Decide for yourself, and speak to a suitably licensed professional before you act. See the Risk Disclosure.
5. Your account and security
You must give accurate information and keep it current. Keep your username, password and bot key secret and secure; do not share them, except that you may create view-only logins for people you trust. You are responsible for everything done through your login and your bot key. Tell us immediately at [email protected] if you think either has been exposed. We may require a stronger password, limit sign-in attempts, end sessions and refuse a login to protect the Service and its users.
6. Acceptable use
You agree not to: (a) connect accounts you are not authorized to view; (b) access another person's data or try to; (c) probe, scan, attack, overload, or bypass the security, rate limits or access controls of the Service; (d) scrape, copy, resell, sublicense or republish the Service, its data or its design except as these Terms allow; (e) reverse engineer or decompile the Service, except where the law gives you that right; (f) upload malware or unlawful material; (g) use the Service to break any law or anyone's rights, or to mislead others (including by showing manipulated statistics as real results); (h) use the bot files or Service for any purpose other than monitoring your own authorized accounts; or (i) help anyone else do any of these things.
7. Market data, news and third-party content
Prices, charts, news, headlines, economic calendar entries and similar content come from third parties and public sources, including financial and news websites, price and data providers and TradingView. It may be delayed, incomplete, interrupted, wrong or removed without notice, and it is provided for information only, not for trading decisions you cannot afford to get wrong. The brokers, platforms, publishers and providers are independent of us, their content and trademarks belong to them, and their own terms and privacy policies apply when you use or follow links to their services. We are not responsible for them. Always confirm balances, positions and prices with your broker, whose records prevail.
8. The bot (Expert Advisor)
The bot files are provided to send read-only account information to your dashboard. They do not trade. You install and run them at your own risk on your own computers or servers, in line with your broker's rules. Keep them up to date; older versions may show incomplete data. You must allow the bot to contact our server address and are responsible for the security of the machine it runs on.
9. Fees and subscriptions
The Service is currently provided without charge. If we introduce paid plans, the price, billing period, renewal and cancellation terms will be shown before you pay and you will be able to cancel before the next renewal. Payments will be handled by a third-party payment processor; we will not store your full card number. Taxes may apply. Except where the law requires otherwise, fees already paid are not refundable. We may change prices or features with reasonable advance notice.
10. Our rights and yours
We and our licensors own the Service, including its software, design, text, logos and trademarks. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service in line with these Terms. You keep all rights in your own data; you give us permission to store, process and display it as needed to run the Service for you. If you send us feedback, we may use it without owing you anything.
11. Privacy
Our Privacy Policy explains what personal data we collect and how we use and protect it, and what rights you have.
12. Availability, changes and suspension
We aim for the Service to be available at all times, but we do not promise that it will be uninterrupted, timely, secure or error-free. We may change, add or remove features, and may suspend or end access (for example for maintenance, security, non-payment, misuse or legal reasons). You may stop using the Service and delete your account at any time; ask us at [email protected] if you want your data deleted.
13. Disclaimer of warranties
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, and that it will meet your needs or give particular results. We do not warrant that any data, statistic, score, report or estimate is correct.
14. Limitation of liability
To the fullest extent the law allows: (a) we are not liable for any trading losses, lost profits or opportunities, or decisions you make or fail to make using or being unable to use the Service; (b) we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, goodwill or revenue; and (c) our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some places do not allow these limits, so they apply only as far as the law permits. Nothing in these Terms limits liability that cannot be limited by law.
15. Indemnity
You agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your content or data, or your violation of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Please contact us first at [email protected]; we will try in good faith to resolve any dispute informally for at least 30 days. If that fails, you and we agree to resolve the dispute by binding individual arbitration administered by the American Arbitration Association under its consumer rules, instead of in court, except that either of us may bring an individual claim in small-claims court and either of us may seek court orders to protect intellectual property or security. You and we waive any right to a jury trial and to bring or join class or representative actions. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration opt-out". If arbitration does not apply, the state and federal courts located in Texas have exclusive jurisdiction and you consent to them. Consumer rights you have under mandatory local law remain unaffected.
17. General
If any part of these Terms is unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them with the Service. These Terms and the documents they refer to are the entire agreement between us about the Service. We are not liable for delays or failures caused by events outside our reasonable control (such as outages, attacks, or acts of government). You agree we may give you notices by email or by posting them on the Service. We may update these Terms; the date at the top shows the latest version and continued use after a change means you accept it. If a change is material we will make a reasonable effort to tell you.
